You are advised to read carefully the following terms and conditions before making a booking. When you book a holiday through us you are entering into a binding contract.
Reservations are accepted by Value Vacations on behalf of
the property owner (the ‘Owner’) only on the
conditions shown on the Booking Form together with the following
booking terms and conditions. Value Vacations act entirely
as Booking Agents for the owners of the properties offered
and contracts accepted by Value Vacations shall be between
the person signing the Booking Form (the ‘Client’)
and the owner of the property for whom the booking is made.
References to ‘you’ or ‘your’ relate
to the person making the booking (the Client) and all members
of the holiday rental party.
Booking
The Client certifies that s/he is authorised to sign the
Booking Form on behalf of all persons who will occupy the
property during the period for which s/he has booked it
and that they are all, apart from infants, aware of the
Booking Terms and Conditions. The Client must be a member
of the party occupying the property.
Upon receipt of the confirmation, the Client must check
the details carefully. If there are any errors, the Client
must tell Value Vacations immediately.
The description of each property clearly indicates the maximum
number of guests who may occupy it and the surrounding grounds.
The Client must not allow more people than the maximum number
stated to occupy the property. Exceeding this number constitutes
a breach of contract and the Owner of the property has the
right to terminate the booking forthwith and all monies
paid by the Client will be forfeit.
The Client must not change the composition
of the holiday rental party from that shown on the booking
confirmation without the prior agreement of Value Vacations.
No booking will be accepted by Value Vacations unless a
Booking Form has been completed and signed by the Client
and accepted by Value Vacations on behalf of the Owner in
writing.
Any property occupied through Value Vacations is strictly
on the basis that the accommodation is for holiday use only,
and that no right to remain in the accommodation exists
in the Client or any person allowed into the property by
him.
Value Vacations reserves the right to refuse any booking.
Arrival and Departure
Properties are available from 4.00pm on the
day of arrival until 10.00am on the day of departure as
shown on the Booking Form. These times must be strictly
adhered to except by special arrangement with Value Vacations
and confirmed in writing by Value Vacations. The Client
will be liable for any extra cost of whatsoever nature incurred
because of a delayed departure.
If your arrival will be delayed beyond 12 noon on the day
after the start date of your holiday rental, you must inform
Value Vacations as soon as possible. If you fail to notify
Value Vacations of your delayed arrival prior to 12 noon
on the day after the start date of your holiday rental,
your booking may be treated as having been cancelled by
you. No refund of any monies paid by you will be made in
this situation.
Neither Value Vacations nor the Owner can accept liability
for any claim arising out of delayed arrival to a holiday
property, or cancellation of the holiday by the Client due
to adverse weather conditions which prevent travel to the
property temporarily or at all.
Cancellations or changes to the booking
If the Client wishes to cancel the booking, for whatever
reason, s/he must telephone Value Vacations on the number
shown on the Booking Form as soon as possible. The Client
must also immediately confirm the cancellation in writing
sent by recorded delivery to Value Vacations at the address
shown on the Booking Form. The day Value Vacations receives
the telephone notification of cancellation is the date on
which the booking is cancelled.
Cancellations received within 8 weeks of the holiday start
date will incur a cancellation charge equivalent to the
total amount payable on the Booking Form. Cancellations
received between 8 and 13 weeks prior to the holiday start
date will incur a cancellation charge equivalent to the
40% deposit plus Booking Fee.
Cancellations received prior to 13 weeks
before the holiday start date will incur a cancellation
charge equivalent to 20% of the total amount payable on
the Booking Form.
It can be prudent to purchase holiday cancellation insurance.
If the reason for cancellation is covered under the terms
of an insurance policy, you may be able to reclaim these
charges, less any excess.
If the Client wants to change the booking once confirmation
has been issued, an administration fee of £30.00 will
be payable to Value Vacations once any change has been made.
However, it is important to realise that a change of property
or dates may have to be treated as the cancellation of one
booking and the making of another. In such cases cancellation
charges may be incurred which may be as much as the total
cost of your holiday booking. Value Vacations will advise
the Client if this is the case when the change is requested.
The Client must then inform Value Vacations as soon as reasonably
possible as to whether s/he still wishes to change the booking.
If the Client advises Value Vacations that s/he does wish
to change the booking or if the Client fails to contact
Value Vacations as soon as reasonably possible, the booking
will be treated as having been cancelled by the Client.
Neither the Owner nor Value Vacations expect to have to
make any changes to your booking, but occasionally problems
occur and bookings have to be changed or cancelled.
If the property should not be available owing to ‘force
majeure’ (e.g. fire, storm, flood, exceptional weather
conditions, epidemics, destruction or damage of the property
by any cause, and all similar situations) or for any other
reason outside the control of the Owner or Value Vacations,
the Owner and Value Vacations shall not be liable, jointly
or individually, for any changes, cancellations, effect
on your holiday, loss or damage suffered by you or for any
failure by the Owner and/or Value Vacations to perform or
properly perform any of their respective obligations to
you.
No compensation, expenses, costs or other sums of any description
(including without limitation the cost of securing an alternative
property/accommodation) will be payable in such circumstances
by either the Owner or Value Vacations to you.
In appropriate cases (for example, where the booking has
to be cancelled by the Owner or Value Vacations before departure)
Value Vacations on behalf of the Owner will refund to the
Client all monies paid to Value Vacations by the Client
for the booking. Value Vacation’s liability is limited
to the refunding of such monies.
The Owner and Value Vacations reserve the right to make
minor changes which would not reasonably have a significant
effect on the confirmed booking.
Payment
Prices quoted are in pounds sterling and are believed to
be correct at the time of printing. Value Vacations reserve
the right to alter prices given, due to errors, omissions
or changes. Whilst price alterations must also apply to
confirmed bookings, if an increase is incurred, the Client
has the right to cancel within 7 working days of notification
of such price increase.
Final payments set out in the Booking Form are due 8 weeks
before a holiday commences. It is regretted that reminders
for any balance outstanding cannot be given. Non payment
of the final amount on the due date will constitute cancellation
of the holiday, forfeiture of the initial deposit payment,
and the Client will remain liable for the full amount of
the final payment. The property will be considered as available
for re-letting without further reference to the Client.
Cheques cannot be accepted for bookings made within two
weeks of your holiday. In the event of a late booking, payment
should be made by Banker’s Draft, Postal Order or
cash sent Registered Post.
We regret that we cannot accept Eurocheques. Overseas visitors
can send a Sterling Draft.
If any payment made by the Client is not
honoured for any reason whatsoever, Value Vacations is entitled
to make an administration charge of £25. Post-dated
cheques are not accepted.
Power, water and telephone services
Rental charges include reasonable use of gas, electricity
and water.
Telephones are not provided in any of our properties.
Linen & cleaning
Duvets and pillows are provided. Linen is
not provided. You should bring your own bed linen (duvet
covers, sheets, pillow slips, bath/hand towels, tea towels)
as appropriate for the numbers and types of beds provided
in your chosen property.
On arrival, the property will have been cleaned. It will
not be further cleaned during tenancies of a week or less.
For tenancies exceeding a week, if requested, properties
will be cleaned weekly on the normal change-over day.
If appropriate, please bring protective waterproof covering
for mattresses should these be required by your party.
Special Needs
If you have special requests or needs you
are responsible for telling us at the time of booking, although
we cannot guarantee that any special requests will be met.
Failure to meet any special request will not be a breach
of contract. It is your responsibility to satisfy yourself
that the property you are booking is completely suitable
for your needs.
Cots, High Chairs and Fold-away Beds
Cots, high chairs and fold-away beds are
not provided in any of the properties.
Subject to special prior agreement with Value Vacations,
Clients may bring their own inflatable beds (and bedding)
for children who are 12 years or under. An additional charge
of £25 per week is made for each child staying under
these circumstances. Note that the Client must not allow
more people than the maximum number stated to occupy the
property in total except by prior agreement with Value Vacations.
Complaints
Every effort has been made to ensure that you have an enjoyable
and memorable holiday. In spite of the care and precautions
taken, however, it is possible that Clients could have grounds
for complaint about the property they have chosen. Any complaint
must be notified immediately to Value Vacations so that
the problem can be speedily resolved. In particular, complaints
of a transient nature (for example, regarding preparation
or heating of the property) cannot possibly be investigated
unless registered whilst the holiday rental party is in
residence. Value Vacations and the Owner will take such
reasonable steps as they are able to in an endeavour to
put the matter right. Value Vacations cannot enter into
correspondence in connection with complaints raised after
the property has been vacated.
All complaints made during the holiday must
be confirmed in writing, to Value Vacations, within 7 days
of the last day of the holiday.
The function of Value Vacations is to act
as Booking Agent and to provide a service letting holiday
properties. Complaints must ultimately be resolved between
the Owner and the Client as Value Vacations is not a party
to the Contract between the Owner and the Client.
Security Deposit & Client Responsibilities
All Clients are required to pay a security
deposit. This will be refunded within the two week period
following the end of the holiday rental (less any costs
for breakages, damage, extra cleaning, etc. if applicable).
Any dispute about a deduction from the Security Deposit
made by the Owner must be taken up directly with them.
The Client agrees to take good care of the
property, to keep the property clean and tidy and to leave
the property in the same state of cleanliness and general
order in which it was found upon arrival.
The Client further agrees not to use the property for any
commercial purpose, including without limitation assigning
or subletting it or otherwise allowing anyone to occupy
it who has not previously been accepted by Value Vacations
on behalf of the Owner.
The Client and other occupants must take all necessary steps
to safeguard their personal property.
The Client will not cause any annoyance or become a nuisance
to tenants or occupants of adjoining premises.
The Client is responsible to the Owner for the full costs
of any damage or breakages in or to the property –
along with any additional costs that may result –
which are caused by any members of the holiday rental party,
and the Owner can require payment from the Client to cover
any such costs.
The Client is responsible for the full cost of any extra
cleaning made necessary as a result of the property being
left in a dirty condition upon the Client’s departure.
The costs of reasonable amounts of gas, electricity and
water are included in the rental rates. The cost of excessive
consumption of gas, electricity and/or water may be deducted
from the security deposit.
The client must leave all keys inside the property upon
departure. Failure to do so will result in a deduction from
the security deposit to cover the cost of replacing the
appropriate locks.
These liabilities are not limited to the amount of any Security
Deposit held.
The Owner is entitled at his/her sole and absolute discretion
to refuse to hand over to the Client, or to repossess, the
property (which includes the fixtures, fittings, furnishings
and decorations). This action may be taken if the Owner
reasonably believes that any member of the holiday rental
party is likely to abuse the property or display rude, dangerous
or offensive behaviour towards the Owner or other third
party, or that any damage is likely to be caused, has been
caused or is being caused by any members of the holiday
rental party. These circumstances will be treated as a cancellation
by the Client. No refund of any monies paid by the Client
in respect of the booking will be made and neither the Owner
nor Value Vacations will have any liability to the Client
as a result of this situation arising (including for example
any costs or expenses incurred by the Client due to not
being able to occupy the property such as the cost of securing
alternative accommodation). In this situation, neither the
Owner nor Value Vacations is under any obligation to find
any alternative accommodation for the members of the holiday
rental party.
Descriptions
Whilst every effort is taken to ensure the accuracy of descriptions
of properties, Value Vacations can accept no liability for
inaccuracies in these details. All distances are approximate.
No warranty or representation is given as to the state of
any property. The colours shown on illustrations may not
be accurate due to technical print reasons, changes of décor
or furnishings or fabrics, or seasonal variations.
Value Vacations cannot accept any responsibility for or
be liable for any loss or damage resulting from information
given or statements made.
Liability
Except in respect of death or personal injury caused by
the negligence of Value Vacations or the Owner and their
respective servants neither Value Vacations nor the Owner
will be liable for any accident, damage, direct or consequential
loss, injury, expenses or inconvenience whether to person
or property which the Client or any other person may suffer
or occur arising out of, or in any way connected with the
letting, or resulting from any other cause whatsoever, including
any activities which may be publicised in the details, howsoever
caused.
Neither the Owner nor Value Vacations can accept responsibility
for any changes or closures to area amenities or attractions.
The use of the amenities provided by the Owners is entirely
at users risk and no responsibility can be accepted for
any injuries to persons or loss or damage to any belongings
of persons who use them.
As Value Vacations acts only as agent for the Owner, Value
Vacations cannot accept any liability for any act(s), omission(s),
neglect or default on the part of the Owner or anyone representing,
or employed by, the Owner, or any other person. Further,
Value Vacations cannot accept any liability for any shortcomings
or defects with or in any property as all properties are
within the sole control of the Owner.
Pets, Smoking, Candles
Regrettably, pets, smoking and candles are prohibited within
all properties and the surrounding grounds. Failure to comply
with this condition may result in the Owner refusing to
hand over the property, or repossessing it. If the Owner
does so, this will be treated as a cancellation by you.
No refund of any monies paid in respect of the booking will
be made and neither the Owner nor Value Vacations will have
any liability to members of the holiday rental party as
a result of this situation.
Bicycles
If you bring a bicycle(s) on holiday, please do not take
them into the property.
Access
Members of the holiday rental party must allow the Owner
and any representative of the Owner (including workmen)
access to the property at any reasonable time during their
occupation of the property (except in cases of emergency
or where a problem needs remedying quickly and the members
of the holiday rental party cannot be contacted in time
– in these situations the Owner is entitled to enter
the property at any time without giving the holiday rental
party prior notice).
Lost Property
If any belongings are left behind and a request
is made to send them on, Value Vacations reserve the right
to charge for the cost of postage and packing plus an administrative
fee of £10. Please ensure you check your accommodation
thoroughly before you leave.
Communicating with you
For the purposes of the Data Protection Act
1998, Value Vacations are the sole data controller of all
personal data provided to Value Vacations by customers and
prospective customers. In order to process bookings, Value
Vacations needs to collect certain personal details from
Clients. We only accumulate information that is essential.
These details will include the Client’s contact information
such as name, address, telephone numbers, email address
and, where applicable, the names, addresses and ages of
members of the holiday rental party. Value Vacations needs
to pass on your personal details to the people and organisations
who need to know them so that your holiday rental can be
provided (for example, the property owner).
You may also be asked to complete a post-holiday questionnaire
which will include your personal details.
Value Vacations needs to process and store your personal
details for its own administration, market analyses and
operational reviews. Value Vacations would also like to
store and use your personal details for future marketing
purposes. All details given at any time will be kept, but
only names, contact details and any booking preferences
will be used for marketing purposes.
Occasionally, Value Vacations may sell or provide customers’
names, contact details and any booking preferences to other
individuals, companies and organisations who offer goods
or services which Value Vacations feels may be of interest
to you.
Value Vacations may make contact with you or any members
of your holiday rental party by post, e-mail, telephone,
including automated dialling equipment, fax, and/or pre-recorded
messages for the purposes set out in this clause after the
end date of the holiday rental. If you do not wish to receive
any or all of the communications set out in this clause,
then please let Value Vacations know as soon as possible
by letter, email or fax. Value Vacations is entitled to
assume that you do not object to being communicated with
unless you have informed Value Vacations to the contrary.
Except where expressly permitted by the Data Protection
Act 1998, Value Vacations will only deal with the personal
details you give as set out above unless you agree otherwise.
Value Vacations has appropriate security measures in place
to protect this information.
You are generally entitled to ask Value Vacations (by letter,
fax or email) what details of yours are being held or processed,
for what purpose and to whom they may be or have been disclosed.
Value Vacations is entitled under the Data Protection Act
1998 to charge a fee in responding to such a request. Value
Vacations promises to respond to your request within 40
days of receiving this in writing and payment of the appropriate
fee. In certain limited cases Value Vacations is entitled
to refuse your request.
Correcting or updating personal information
The Client may change any information previously provided
to us by telephoning, emailing or writing to us, giving
their full postal address.
Law
All Contracts will be deemed to have been made in Cornwall
and are in accordance with and subject to English Law.
The Booking Terms and Conditions, the Booking Form and the
property descriptions provided by Value Vacations shall
prevail over any terms and conditions of the Client made
or customary practise or previous course of dealing.
Property descriptions and booking terms and conditions cancel
all previous literature and prices.
